At Clusteo (authorized seller by Perceval) we are passionate about making things easy, accessible, and efficient. That’s why this Data Protection Notice (“Notice”) is no exception. We give transparent, concise and effective information on how we use your personal data collected (i) on our website (“Website”), (ii) from public data sources, (iii) by our commercial representatives, (iv) by developing commercial relationships, or (v) by using our products or services. We hope that this Notice will help you understand how we manage your data so that you may make informed decisions and maintain control over your information.

We invite you to spend a few moments understanding this Notice. We may update this Notice from time to time. If we do, we will post the new version here and/or try to notify you as soon as possible and as needed. If you continue to use our products and services after we have notified you of the changes, when applicable, or posted the new version, we will process your personal data in accordance with the terms of the updated notice.

1.1. We are Clusteo S.A. (B.C.E 0441.430.469), responsible for processing your personal data, located at Rue Tenbosch 9, B-1000, Brussels, Belgium.

2.1. We use the following categories of personal data:

2.1.1. Registration Data. When you register with us, or request an offer, you may fill out forms and provide us with basic information about yourself and your purchase intention, such as your full name, login, physical and email address, telephone and mobile phone number, consumption data, past purchases, data about the installation site, and language. You may also provide us with a copy of identification documentation for ID checks. You are responsible for the accuracy of the information you provide to us.

2.1.2. Contact Data. When you send us email or contact us by phone, we may have access to your name, email address, phone, and other data that is disclosed in your messages or calls, such as purchase intent, partnership, feedback, or other purposes.

2.1.3. Financial Information. If you make any payments on the Website, your credit/debit card details will be processed directly by a third party processor who will store all payment information and transaction details. We will retain only the transaction details and we will not retain your credit or debit card information. The same is true for other financial transactions, such as in the case of a bank transfer.

2.1.4. Technical Information. When you use our Website, we only collect the strictly technical information, e.g. the address used to connect your mobile phone or other device to the Internet (IP address).

2.1.5. Cookies. We do not collect any cookies.

2.1.6. Analytical Information. After installation of our products, we may process analytical information regarding the use of our products, such as consumption data, only for your personal use and control.

2.1.7. Location Data. We may process your location data from our local visits or from public data sources for marketing purposes, always respecting your legitimate interest.

2.1.8. Installation Data. During our visit, or prior to installation, with your prior knowledge and authorization, it is possible to access or collect photos of your place for evaluation and control purposes of the installation procedures.

2.2. We may collect your personal information, with your authorization (where applicable), in a variety of ways, such as: by phone, in writing via email, message, e-forms or an app or when you use social media to contact us.

The purposes for which we use your personal data and the legal grounds on which we do so are as follows:

3.1. Providing you with a service. We obtain and use your registration data, analytical and financial information to establish a contractual relationship, to be able to provide the services to you, to install the product on site, to monitor the performance of the product/service, to solve technical problems and to charge you correctly. (Article 6(1)(b) GDPR – General Data Protection Regulation)

3.2. Improving our products or services. Based on analytical data, feedback and other parameters, to provide a better experience for you, always based on legitimate expectations. (Article 6(1)(f) GDPR)

3.3. Fraud prevention. When necessary, we may need to share and process personal and financial details to combat fraud, phishing and identity theft. The legal basis here is the legitimate interest of both you and us, protecting you against misuse of your identity or other types of fraud. (Article 6(1)(f) GDPR)

3.4. Keeping you up to date. We may use your email, address, phone number and other registration data to contact you, answer your questions, or present you with occasional updates and marketing messages, based on a legitimate interest and subject to your right to opt-out at any time. (Article 6(1)(f) GDPR)

3.5. Accounting. We store invoices and similar documents for accounting purposes, including general personal information such as name, address, and service description. We store such documents to comply with our legal obligations. (Article 6(1)(c) GDPR)

3.6. Legal obligations. We also have a legal obligation to disclose certain personal data at the request of the judicial authorities in the context of a judicial inquiry, and of other Belgian authorities such as tax authorities and judicial authorities, or in cases of dispute management. (Article 6(1)(c) GDPR)

4.1. Partners. We may share your personal data with members of our corporate group or partners. This is to help us provide our services to you and to promote our marketing activities.

4.2. Subcontractors. We may share your personal data with companies we hire to provide services on our behalf.

4.3. Providers. Providers of software and other information technology for the purposes of data storage and other administrative functionality necessary for Clusteo’s operation, as well as financial/banking institutions for payment processing.

4.4.Such third parties only have access to data on a need-to-know basis to enable them to perform their tasks on our behalf and for legitimate purposes, which are always supported by a legal basis.

4.5. Except as described above and unless permitted by law, we will not provide your personal data to any other person.

4.6. We primarily use processors in the EU/EEA or processors that store data in the EU/EEA. If it is not possible, data processors outside the EU/EEA may be used, but only if they can provide your data with adequate protection.

5.1. We will stop processing your data in the following cases:

(a) When the purpose for which your personal data was collected is achieved and/or such data is no longer necessary or relevant to the purpose.

(b) When you are entitled to request the termination of the processing and the deletion of your personal data .

(c) When there is a legal determination to this effect or after the time required by law.

6.1. Once we have received your information, we will use strict procedures and security features to try to prevent leak, loss or damage.

6.1.1. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Notice.

7.1. According to the General Data Protection Regulation (GDPR), you have the following rights:

(a) you have the right to require access to your personal data.

(b) to correct or update your personal data.

(c) to request the erasure of your personal data in particular cases (e.g. if your personal data has been unlawfully processed).

(d) to object to the use of certain personal data, unless there is a legal basis for continued use.

You may also opt-out directly from marketing emails and texts that we send you.

(e) to withdraw a previously given consent at any time.

(f) to object to the automatic processing of your personal data. However, in Clusteo we do not take decisions on your personal data without human intervention.

(g) to transfer your personal data that you provided to Clusteo to yourself or a third party. The data must be transmitted in a structured, commonly used and machine-readable format

7.2. You may demand the disclosure, correction and suspension of use of the information, among other requests, at privacy@percevalpower.be.

7.2.1. In order to prevent fraud, we may require you to provide some information to validate your identity.

7.3. You can also file a complaint with the Data Protection Authority if you are unhappy with how we handle your data.

7.3.1. In general, we encourage you to read more about the GDPR to be up to date on the rules, in addition to reading this Notice and contacting us before.
